1. Acceptance of Terms

Welcome to AI Erik Learning House, operated by AI Erik (Erik Conn) LLC doing business as AI Erik ("we," "us," "our," or "Company"). By accessing or using our website, services, content, or membership platform (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

We reserve the right to modify, update, or change these Terms at any time without prior notice. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically for updates.

2. Eligibility and Account Registration

The Service is intended for individuals who are at least eighteen (18) years of age. By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

When you register for an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or any other breach of security.

Account sharing is strictly prohibited. Each membership account is for use by one individual only. You may not share your login credentials with any other person or allow multiple individuals to access the Service using a single account. Violation of this policy may result in immediate termination of your account without refund.

3. Description of Service

AI Erik Learning House provides an online membership-based educational platform focused on Artificial Intelligence and Prompting Techniques. Our Service includes, but is not limited to:

  • Access to educational course content, lessons, and modules organized by skill level
  • Downloadable resources including PDFs, flashcards, and study materials
  • Weekly live interactive sessions with the instructor (some sessions may be recorded)
  • Curated AI news and industry updates
  • Community discussion features for member interaction
  • Video library with instructional content

The specific features, content, and availability of the Service may change at any time at our sole discretion.

4. Free Trial Period

New members may be eligible for a seven (7) day free trial period. During the free trial, you will have full access to the Service at no charge. If you do not cancel your membership before the end of the free trial period, your payment method will automatically be charged the applicable subscription fee, and your paid membership will begin.

Free trials are limited to one per person. We reserve the right to determine eligibility for free trials and to revoke free trial access if we suspect fraud or abuse.

5. Subscription and Payment Terms

5.1 Subscription Fees

Access to the Service requires a paid subscription. The current subscription fee is $9.99 per month (the "Subscription Fee"). All fees are in U.S. Dollars and are subject to change at our discretion with advance notice.

5.2 Billing and Auto-Renewal

By subscribing to the Service, you authorize us to charge your designated payment method on a recurring monthly basis. Your subscription will automatically renew at the end of each billing cycle unless you cancel prior to the renewal date. You are responsible for ensuring that your payment information is current and accurate.

5.3 Failed Payments

If a payment fails or is declined, we may suspend or terminate your access to the Service. You remain responsible for any uncollected amounts. We reserve the right to retry failed payments and to charge any applicable late fees or collection costs.

5.4 Price Changes

We reserve the right to modify the Subscription Fee at any time. If we increase the price of your subscription, we will provide you with at least thirty (30) days' advance notice. Your continued use of the Service after the price change takes effect constitutes your acceptance of the new price.

6. Cancellation and Refunds

6.1 Cancellation by Member

You may cancel your subscription at any time through your account settings or by contacting us directly. Upon cancellation, your access to the Service will continue until the end of your current billing period. You will not be charged for subsequent billing cycles after cancellation.

Cancellation does not entitle you to a refund for any fees already paid. You remain responsible for all charges incurred prior to cancellation.

6.2 No Refund Policy

ALL SUBSCRIPTION FEES ARE NON-REFUNDABLE. We do not provide refunds or credits for partial months of service, unused content, or any other circumstance. This no-refund policy applies regardless of whether you cancel voluntarily, your account is terminated by us, or you are dissatisfied with the Service for any reason.

By subscribing to the Service, you acknowledge and agree to this no-refund policy.

6.3 Termination by Company

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violation of these Terms, fraudulent activity, abusive behavior, or any conduct that we deem harmful to the Service or other members. Termination by the Company does not entitle you to any refund.

7. Content Ownership and License

7.1 Our Intellectual Property

All content available through the Service, including but not limited to course materials, videos, PDFs, flashcards, text, graphics, logos, images, audio, and software (collectively, "Content"), is the exclusive property of AI Erik (Erik Conn) LLC dba AI Erik or its licensors and is protected by copyright, trademark, and other intellectual property laws.

7.2 Limited License to Members

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Content solely for your personal, non-commercial educational purposes. This license terminates automatically upon cancellation or termination of your membership.

7.3 Permitted Uses

You may download PDFs, flashcards, and other downloadable materials provided through the Service for your personal use. If you use, share, or reference any Content in any business, teaching, or public context, you must provide clear attribution to AI Erik and AI Erik (Erik Conn) LLC. For example: "Source: AI Erik Learning House (AILiteracy.biz)" or similar credit.

7.4 PDF Download Limits

To prevent abuse and ensure fair access for all members, PDF downloads are limited to three (3) PDFs per member per day. This limit resets at midnight (server time) each day. Unused downloads do not roll over to the next day.

Members who reach their daily download limit will see a "Daily Limit Reached" message and will be able to download additional PDFs starting the next day. This policy helps protect our educational content from bulk downloading and redistribution while ensuring that active, engaged members have consistent access to learning materials.

By subscribing to the Service, you acknowledge and agree to this download limit policy. Attempts to circumvent or abuse this limit (such as creating multiple accounts) may result in immediate termination of your membership without refund.

7.5 Prohibited Uses

You may not:

  • Reproduce, distribute, publicly display, or create derivative works from the Content without our express written permission
  • Remove, alter, or obscure any copyright, trademark, or other proprietary notices from the Content
  • Use the Content for any commercial purpose without authorization
  • Share your account credentials or allow others to access the Service using your account
  • Scrape, data mine, or use automated tools to extract Content from the Service
  • Sell, rent, lease, or sublicense access to the Content or the Service

Violation of these restrictions may result in immediate termination of your account and may subject you to legal liability.

8. User Conduct and Community Guidelines

You agree to use the Service in a lawful and respectful manner. Prohibited conduct includes, but is not limited to:

  • Harassing, threatening, or abusing other members or staff
  • Posting or transmitting any content that is illegal, obscene, defamatory, or infringes on the rights of others
  • Engaging in spamming, phishing, or other fraudulent activities
  • Disrupting or interfering with the operation of the Service or the experience of other users
  • Impersonating any person or entity or misrepresenting your affiliation with any person or entity
  • Uploading viruses, malware, or any other harmful code

We reserve the right to remove any user-generated content and to suspend or terminate accounts that violate these guidelines.

9. Live Sessions and Recordings

9.1 Participation in Live Sessions

The Service may include live interactive sessions conducted via video conferencing platforms such as StreamYard. Participation in live sessions is voluntary. You may be asked to appear on camera or share audio during sessions.

9.2 Recording and Consent

Some live sessions may be recorded for educational purposes and made available to members for later viewing. By participating in a live session, you acknowledge that the session may be recorded. We will seek your explicit consent before recording any session in which you are an active participant (e.g., appearing on camera or speaking).

If you do not wish to be recorded, you may choose not to participate in recorded sessions or to participate without activating your camera or microphone.

9.3 Use of Recordings

Recorded sessions are provided solely for the educational benefit of our members. You may not download, redistribute, or publicly share any recordings without our express written permission.

10. Third-Party Services

The Service may integrate with or link to third-party services, including but not limited to payment processors (Stripe), video conferencing platforms (StreamYard), and external websites. We are not responsible for the content, privacy practices, or terms of service of any third-party services. Your use of third-party services is governed by their respective terms and policies.

11. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We may add, remove, or change features, content, pricing, or availability without liability to you. Your continued use of the Service after any such changes constitutes your acceptance of the modifications.

12. Disclaimers and Warranties

12.1 "As-Is" Service

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

12.2 No Guarantee of Results

We make no representations or warranties regarding the accuracy, completeness, or usefulness of the Content. The educational materials provided through the Service are for informational purposes only and do not guarantee any specific outcomes, career advancement, or financial success.

12.3 Availability

We do not warrant that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components. You acknowledge that your use of the Service is at your own risk.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ERIK CONN LLC DBA AI ERIK, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

14. Indemnification

You agree to indemnify, defend, and hold harmless AI Erik (Erik Conn) LLC dba AI Erik, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Your user-generated content or conduct

15. Dispute Resolution and Arbitration

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.

15.2 Mandatory Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration, rather than in court. You and the Company agree to submit all disputes to final and binding arbitration before a single arbitrator in accordance with the rules of the American Arbitration Association (AAA).

The arbitration shall take place in New York State, or at another mutually agreed location. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

15.3 Waiver of Class Actions

YOU AND THE COMPANY AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. You waive any right to participate in a class action lawsuit or class-wide arbitration.

15.4 Exceptions

Notwithstanding the foregoing, either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.

16. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection and use of your information as described in the Privacy Policy.

17. Entire Agreement

These Terms, together with our Privacy Policy and any other policies or guidelines posted on the Service, constitute the entire agreement between you and AI Erik (Erik Conn) LLC dba AI Erik regarding your use of the Service and supersede all prior agreements, understandings, and representations.

18. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

19. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of the Company.
